Agreement to Terms
By downloading, installing, or using eyeSpeed (“the App”), or by using the eyeSpeed.app website (including the support form), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App or website.
These Terms supplement Apple’s standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and Apple’s EULA, the more restrictive provision applies.
Description of Service
eyeSpeed is a GPS-based speedometer application for iOS devices. The App uses your device’s GPS receiver to estimate your current speed and display it on screen, including through iOS Live Activities on the Lock Screen and Dynamic Island.
These Terms also apply to your use of the eyeSpeed.app website, including the support form at eyespeed.app/support. Submitting the support form constitutes your agreement to these Terms.
Speed Data Disclaimer
eyeSpeed is provided for entertainment and informational purposes only.
GPS-based speed readings are estimates and are inherently subject to inaccuracy. Speed data displayed by eyeSpeed may differ from your actual speed due to factors including but not limited to:
- GPS signal quality, interference, or obstruction
- Device hardware limitations
- Atmospheric and environmental conditions
- Multipath signal reflection (tunnels, urban canyons, dense foliage)
- Satellite geometry and availability
- Device motion and orientation
eyeSpeed is not a substitute for your vehicle’s speedometer. You should always rely on your vehicle’s built-in speedometer and obey all posted speed limits and traffic laws. Do not rely on eyeSpeed for any purpose where inaccurate speed data could result in legal consequences, personal injury, property damage, or any other harm.
You are solely responsible for your driving behavior at all times. eyeHear, LLC assumes no responsibility for traffic violations, accidents, injuries, or any other consequences arising from your use of the App.
Acceptable Use
You agree to use eyeSpeed only in compliance with all applicable laws and regulations. You agree not to:
- Rely on eyeSpeed as your sole or primary speedometer while operating a vehicle
- Use the App in any manner that distracts from safe driving
- Use the App to contest or dispute the accuracy of law enforcement speed measurements
- Reverse engineer, decompile, or disassemble the App
Intellectual Property
eyeSpeed and all associated trademarks, logos, and content are the property of eyeHear, LLC. Your purchase grants you a limited, non-exclusive, non-transferable license to use the App on your Apple devices in accordance with these Terms and Apple’s EULA.
Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EYEHEAR, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF ACCURACY, RELIABILITY, OR COMPLETENESS OF SPEED DATA
- WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
No advice or information obtained from eyeHear, LLC or through the App shall create any warranty not expressly stated in these Terms.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYEHEAR, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Traffic citations, fines, or legal penalties
- Vehicle accidents, personal injury, or property damage
- Loss of data, revenue, or profits
- Any damages arising from reliance on speed data displayed by the App
IN NO EVENT SHALL EYEHEAR, LLC’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP.
This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, strict liability, or any other theory, even if eyeHear, LLC has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless eyeHear, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any law or regulation.
Apple’s Standard EULA
Your use of eyeSpeed is also governed by Apple’s standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula.
Changes to These Terms
eyeHear, LLC reserves the right to modify these Terms at any time. Changes will be posted at terms.eyespeed.app and noted in the release notes of app updates. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Chesterfield County, Virginia, or the United States District Court for the Eastern District of Virginia.
